About this policy

This policy explains how Pathplan (Pty) Ltd (“Pathplan”, “we”, “us”) handles personal information when you contact us, use our website, work with us or engage our traffic management services. These services include traffic, parking and pedestrian planning, on-site traffic control, road closures and detours, signage, equipment rental and permit assistance.

We process personal information in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA). This policy applies to information processed by Pathplan. Partner companies are responsible for their own processing.

Information we collect

Depending on the enquiry, service or working relationship, relevant information may include:

  • Names, company details, contact numbers, email and physical addresses.

  • Enquiries, quotations, contracts, correspondence, invoices, tax and payment information.

  • Event and venue details, traffic plans, vehicle registration or access information, deployment records and incident reports.

  • Employee, applicant and contractor identity, qualifications, relevant training, employment, attendance, payroll and banking information.

  • Emergency contact or health information where lawfully necessary for employment, incident reporting or arranging assistance.

  • Information submitted through website forms and relevant technical information processed by our website services.

Special personal information and information about children are processed only where lawful and necessary. Please agree a suitable communication method with us before sending sensitive personal or operational information.

How we obtain information

We generally obtain information directly from you through forms, applications, contracts and correspondence. Where necessary and lawful, we may obtain relevant information from your authorised representative, event organisers, venues, appointed contractors, operational records or established credit bureaux where a credit assessment is required.

Why we use information

  • Respond to enquiries, assess requirements and prepare quotations.

  • Plan and deliver agreed traffic management services.

  • Coordinate with clients, venues, contractors and relevant authorities.

  • Prepare permit applications and emergency access arrangements where engaged to do so.

  • Recruit, train, deploy and administer personnel.

  • Manage accounts, payments, contracts, equipment and business records.

  • Record incidents, arrange assistance and meet legal obligations.

  • Establish, exercise or defend legal rights.

Providing information for an enquiry is voluntary. Without the information needed to assess or fulfil your request, we may be unable to respond fully or provide the service. Where information is required by law or contract, we will explain this when collecting it.

Lawful grounds for processing

Depending on the purpose, processing may be necessary for a contract, a legal obligation, your legitimate interests, or our legitimate interests or those of a third party. Where consent is the applicable basis, we request it. Further processing must have a lawful basis and meet POPIA’s requirements. Direct marketing is subject to applicable consent requirements and your right to object or opt out.

Sharing information

Relevant information may be shared with authorised personnel, clients and venues where needed for the service, appointed contractors, technology and administrative providers, professional advisers, insurers and emergency services. Disclosure to regulators, courts, law enforcement or other authorities must be required or permitted by law.

Operators processing information on our behalf must protect its confidentiality and security and act within authorised instructions. We do not sell personal information.

Information processed outside South Africa

Email, hosting, cloud storage and other software providers may process information outside South Africa. Any transfer must meet section 72 of POPIA, including protection through applicable law, binding agreements or another permitted basis.

Cookies and external services

Our website and its service providers may use cookies and similar technologies for operation, functionality and measurement. Browser settings allow you to manage cookies; restrictions may affect features. Where consent is required, it must be obtained. External websites and services have their own privacy notices. We remain responsible for information processed on our behalf as required by law.

Security and retention

We use reasonable organisational and technical safeguards appropriate to the information and risks, including restricted access, confidentiality requirements and protection of electronic and physical records. Information is retained for its purpose or as otherwise lawfully required or permitted. When retention is no longer justified, we securely destroy, delete or de-identify it. Security compromises are notified as required by POPIA.

Your rights and complaints

Subject to applicable legal requirements, you may ask whether we hold information about you, request access, request correction or deletion where justified, object to processing, request restriction where applicable, and withdraw consent where processing relies on consent. You may also object to direct marketing. We may need to verify your identity.
